Terms of Service


Please read this Agreement carefully as it governs your use of the website www.dramsdelivered.com (the 'Site'). By continuing to use the Site you are agreeing to the terms set out below and are confirming that you are above the Irish legal age to purchase alcohol, which currently stands at 18 years of age. Persons under the legal age to purchase alcohol in Ireland are not permitted to purchase, receive or subscribe to any goods or services from this site.

Provision of Web Site Service


The Site is owned and operated by Celtic Whiskey Shop Ltd. (“the Company”) The Company is incorporated in Ireland with Registered No: 367358 and VAT Registration No. IE6387358K. Its registered office is at 27-28 Dawson Street, Dublin 2.

“Drams Delivered” and “Celtic Whiskey Bar and Larder” are trading names of the Company.

Limited Rights to Use Content


All material, including any intellectual property displayed on the Site ("Content"), belongs to the Company or its suppliers. The Site gives you the right, for your own personal or non-commercial purposes only to (1) retrieve and display the Content on your PC screen; (2) print individual pages on paper; (3) store individual pages in electronic format. You may not store any Content on any server or other storage device connected to an external network, or make any other use of the Content.

You may not, without prior written permission given by the Company within the previous six months, (1) redistribute any of the Content or supply it to other people; (2) remove the copyright or trade mark notices from any copies of Content made under this Agreement; (3) create a database in any form (including electronic or structured manual form) by downloading, copying and storing all or any of the Content; (4) except as expressly set in this Agreement, modify, reproduce or in any way use any of the Content.

Purchases


The prices for goods displayed for sale on the Site are as set out on the Site and are inclusive of relevant VAT and Duty at rates valid as of time of purchase. Where additional charges are made for delivery, they are clearly displayed.

By completing and submitting the electronic order form on the site you are making an offer to purchase goods which, if accepted by us, will result in a binding contract.

By making that offer to purchase goods, you are also authorising the Company to deduct the amount from the card or payment method provided. We will confirm acceptance of your order by email, stating that the goods ordered have been dispatched. This confirmation will be sent to the email address you provide on your order details. Whether or not you receive an email, our acceptance of your order will create a legally binding contract between us. We reserve the right not to supply you at our discretion. Where we are unable to fulfil part or all of your order, we will contact you and arrange to refund that amount to you.

In the case of a web order being of over €2000 (inclusive of postage) we will ask for payment via bank transfer or PayPal and any credit card payment already made will be refunded. This may cause a slight delay to delivery times but is a necessary security measure.

Delivery


The Drams Delivered website offer an international delivery service through third party logistics providers. More information can be found on our delivery information page.

Goods must be ordered by and received by a person 18 years of age or older (or persons of the requisite minimum legal age for ordering alcoholic products in the place of the order).

*Important Information: Whilst we try to maintain a very high standard of service there is always an element of risk in sending alcohol overseas. Therefore we must warn our customers that there may be possibilities of customs charges or seizures when sending goods to certain countries. In the event of such charges or seizures, The Celtic Whiskey Shop Limited will not be responsible for the payment of these additional charges, and we will not be able to offer any form of compensation or refund.

We will label our goods in such a way to minimise any charges or seizures but in some cases they may be unavoidable. If you have any concerns regarding shipping to your country, we recommend contacting us prior to placing an order.

Cancellation of Orders, Returns & Refunds


Occasionally errors can arise in the pricing and information displayed for our products. In the event of such errors, we reserve the right to cancel sales and refund the customer for the amount paid.

You can cancel your order, however this must be done by email within 3 hours of purchasing.

If you wish to cancel the order after the product has been delivered, you may do so, however the product must be returned to us undamaged, and with all seals intact, at your own expense. In such circumstance you will be reimbursed after we have received the goods back. Simply contact us by phone on +353 64 663 5700, or email info@celticwhiskeybar.com. To help us assist you as quickly as possible please quote your order reference number.

You are entitled to a cooling-off period of 7 working days, which begins on the day after you receive delivery of your order. During the cooling-off period, you may cancel your order for any reason and provide notification to the Company that you will be returning the product and accept to pay the cost of returning the product. Refunds will only be issued including shipping costs if items were delivered in error, defective or badly damaged. Upon cancellation, we will make the necessary arrangements to facilitate the return of the order and will reimburse you within 14 days. While we are more than happy to help if you wish to return goods that are not faulty or damaged you will be responsible for any costs incurred in returning the goods.

We work hard to ensure that our goods arrive at your door exactly as they left ours. Unfortunately, accidents can happen. In the unfortunate case of goods becoming broken or damaged in transit, we will offer the choice of either a replacement or a full refund including any delivery costs incurred.

Refunded orders must be returned in the original packaging and in good condition for the refund to be granted.

Images on our website are for illustration only and might not be an exact representation of the product We will do our best to inform you if this is the case.

Errors sometime occur. If a product is displaying incorrect details such as batch number, wrong alcoholic strength or if the label is different version we will not be held responsible for any such errors and will not be able to offer a refund or replacement. If you are in any kind of doubt, if you require a specific batch, series number, cask strength or single cask item then please double check with us before ordering.

Data Protection and Cookie Policy


We are committed to protecting the personal data of anyone who uses our website. The information that you provide about yourself to the Company will only be used by us in accordance with our Data Protection Policy which is published on the Site or available to you if you request the same from us.

Modifications to Website Content


In endeavouring to improve the Site and services offered, the Company reserves the right at all times to make changes to the Content, including these Terms & Conditions. Prices and products are subject to change without notification. You will be subject to the policies and Terms of Service in place at the time of your visit to the Site.

General


There is no specific time limit applying to your access and use of the site. However, the Company reserves the right to suspend or terminate your access and use at any time. It may exercise this right with or without notice.

You may not assign, sub-licence or otherwise transfer this Agreement or your rights of access to the Site.

Failure by either party to exercise any right or remedy under this Agreement does not constitute a waiver of that right or remedy Irish law will apply to this Agreement and both you and the Company agree to submit to the exclusive jurisdiction of the Irish Courts. All contracts that result from the use of the Site are concluded in English.

Relevant legislation governing these Terms & Conditions, incudes the Sales of Goods (Supply of Services) Act, 1980, the Consumer Information Act, 1978, the Electronic Commerce Act, 2000, the EU Directive on Distance Selling, SI 207 of 2001 and SI 68 of 2003, the Data Protection, Act 1998, the Data Protection (Amendment) Act, 2003 and the Copyright & Related Rights Act, 2000.
